1. Introduction

These Terms of Service ("Terms") govern your use of the website fig.ltd.uk ("Website") and any web design, development, and hosting services ("Services") provided by Fig Limited ("Fig", "we", "us", or "our"), a company registered in England with its principal place of business in Penwortham, Preston, Lancashire.

By accessing our Website or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or Services.

Fig provides website design, development, and hosting services. Our pricing is made up of three simple components:

To use certain features of our Website or to subscribe to a plan, you may need to create an account. You agree to provide accurate, complete, and current information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Payment and Billing

• All prices are quoted in British Pounds Sterling (£) and are inclusive of VAT where applicable.
• The Design & Build fee is payable up front before work begins.
• Domain registration and renewal fees are billed annually and are charged at cost based on the TLD chosen.
• Hosting is provided free of charge for the duration of your engagement with Fig.
• We may change our prices with 30 days' written notice. Continued use of the Services after a price change constitutes acceptance of the new price.
• If a payment fails, we will notify you and provide a reasonable grace period. Continued non-payment may result in suspension of your Services.
• We do not store your payment card details. All payments are processed securely through our third-party payment provider.

5. Website Design and Development

• We will design and build your website based on the requirements discussed and agreed with you.
• You are responsible for providing all content (text, images, logos) in a timely manner.
• We retain ownership of all design files, source code, and templates until full payment has been received. Upon payment, you receive a licence to use the website for as long as your engagement with Fig is active.
• We reserve the right to display a discreet "Powered by Fig" credit on websites we build, unless otherwise agreed in writing.

6. Hosting and Uptime

We aim to provide reliable hosting with minimal downtime. While we strive for high availability, we do not guarantee 100% uptime and shall not be liable for any losses arising from service interruptions caused by factors beyond our reasonable control, including but not limited to server maintenance, third-party provider outages, or force majeure events.

We perform regular backups of hosted websites. However, you are encouraged to maintain your own backups of any content you upload.

7. Your Responsibilities

As a user of our Website and Services, you agree:

• Not to use the Services for any unlawful purpose or in violation of any applicable laws or regulations.
• Not to upload or distribute any content that is defamatory, obscene, infringing, or otherwise harmful.
• Not to attempt to gain unauthorised access to our systems, servers, or networks.
• Not to use the Services to send unsolicited bulk communications (spam).
• To ensure that any content you provide for your website does not infringe the intellectual property rights of any third party.

8. Intellectual Property

All content on the Fig website, including text, graphics, logos, and software, is the property of Fig Limited or its licensors and is protected by copyright and other intellectual property laws.

You retain ownership of any content you provide to us for use on your website. By providing content to us, you grant Fig a non-exclusive licence to use, reproduce, and display that content solely for the purpose of delivering the Services.

9. Cancellation and Termination

• You may cancel your engagement with Fig at any time by contacting us at support@fig.ltd.uk.
• The Design & Build fee is non-refundable once work has commenced.
• Domain fees already paid for the current year are non-refundable. You may request a transfer of your domain to another registrar at any time.
• Upon cancellation, your website will be taken offline. We will retain your data for 30 days, during which time you may request a copy of your website files.
• We reserve the right to suspend or terminate your Services immediately if you breach these Terms, fail to make payment after reasonable notice, or use the Services for unlawful purposes.

10. Limitation of Liability

To the maximum extent permitted by law, Fig Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or in connection with these Terms or the use of our Services.

Our total liability for any claim arising under these Terms shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

11. Indemnification

You agree to indemnify and hold harmless Fig Limited, its directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Services, your breach of these Terms, or your violation of any third-party rights.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, power failures, internet disruptions, or cyber attacks.
